By using the website located at ennisfence.com (the "Site") or engaging Custom Ennis Fence ("we," "us," or "our") for fence-related services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use this Site or our services.
We may update these terms at any time by posting a revised version on this page with an updated effective date. Your continued use of the Site or our services after any changes constitutes your acceptance of the updated terms.
Custom Ennis Fence provides residential and commercial fence installation, repair, replacement, and related services in Ennis, TX and surrounding areas. Services include, but are not limited to, wood fence installation, vinyl fence installation, chain link fencing, aluminum fencing, privacy fencing, ornamental iron fencing, automatic gate installation, and fence staining and sealing.
We reserve the right to decline any project at our sole discretion, including projects outside our service area or scope of work.
All estimates provided by Custom Ennis Fence are based on information gathered during an on-site visit or from details provided by the customer. Estimates are written and provided before any work begins. The final price reflected in a signed written estimate or contract is the price you will pay, unless you request additional work or changes after the estimate is accepted.
Estimates are valid for 30 days from the date issued. Material prices and availability are subject to change; if significant changes occur after an estimate is issued but before work begins, we will notify you and obtain your approval before proceeding.
Verbal quotes or phone estimates are non-binding. A written, signed estimate or contract is required before any work begins.
Project scheduling is confirmed in writing or by mutual agreement. We make reasonable efforts to adhere to scheduled dates, but delays may occur due to weather, material availability, permitting timelines, or circumstances beyond our control. We will notify you of any significant scheduling changes as soon as possible.
If you need to cancel or reschedule a confirmed project, please notify us at least 48 hours in advance. Cancellations made after materials have been ordered or work has begun may be subject to a restocking or cancellation fee to cover costs already incurred. The specific amount will be outlined in your written contract.
Payment terms are outlined in each written estimate or contract. We typically require a deposit before work begins, with the remaining balance due upon completion. The specific deposit amount and payment schedule will be clearly stated in your written agreement.
Payment is accepted by cash, check, or other methods specified at the time of contracting. Returned checks are subject to a returned-check fee. Balances not paid within the agreed timeframe may be subject to a late fee and may be referred to a collections process. You are responsible for any reasonable costs we incur collecting an overdue balance, including attorney fees where permitted by law.
Where required, we will obtain the necessary building permits from the applicable local authority (such as the City of Ennis) before work begins. Permit fees are either included in your estimate or listed as a separate line item. It is your responsibility to provide accurate property information, including property lines and any applicable HOA restrictions. We are not liable for delays or costs resulting from inaccurate information you provide.
If you have an HOA, it is your responsibility to obtain any required HOA approval before work begins. We can assist with style and specification questions, but HOA approval is your responsibility.
We stand behind our workmanship. If a defect in our installation is identified within a reasonable period after completion, we will return to correct it at no charge. What constitutes a defect in workmanship and the applicable correction period will be described in your written contract.
Our workmanship warranty does not cover:
Materials may carry separate manufacturer warranties. We will provide relevant warranty documentation for materials where available.
Except as described in this section, Custom Ennis Fence provides services on an "as is" basis and makes no other express or implied warranties.
To the fullest extent permitted by applicable law, Custom Ennis Fence shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services or this Site, even if we were advised of the possibility of such damages.
Our total liability to you for any claim arising from services rendered shall not exceed the total amount you paid us for the specific project giving rise to the claim.
We prefer to resolve any disputes directly and informally. If you have a concern about our work or billing, please contact us first so we have an opportunity to make it right. Most issues can be resolved quickly with direct communication.
If a dispute cannot be resolved informally, the parties agree to attempt good-faith mediation before pursuing legal action. Any legal proceeding not resolved through mediation shall be brought in the appropriate court located in Ellis County, TX.
These Terms and Conditions are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising under these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Ellis County, Texas.
